MYSTERY GIFT CARD GIVEAWAY OFFICIAL RULES

1. Sponsor: BI-LO, LLC, 8928 Prominence Parkway, Building 200, Jacksonville, FL 32256, operating stores under the following banners: BI-LO, Winn-Dixie, Harveys Supermarket, and Fresco y Más (each a “Store”).
2. HERE’S HOW TO PARTICIPATE IN THE MYSTERY GIFT CARD GIVEAWAY (“Giveaway”): Attend a Store grand opening, reopening, conversion, or other celebration (each an “Event”) at the start of the Event. Mystery gift cards of unknown value will be given out until the end of the Event or until all available mystery gift cards have been distributed, whichever comes first (“Promotion Period”): ENTRY: The number of mystery gift cards and their amounts will vary by Event. You will be eligible to receive ONE free mystery gift card when you are one of the first customers at the Store during the Promotion Period. Being one of the first customers to enter each Store while mystery gift cards remain will acknowledge eligibility for the Giveaway. Mystery gift cards are limited and valid at any Store location operating under the same banner as the Store in which the mystery gift card was received. A customer reward card is not required for eligibility. Sponsor does not assume any responsibility for incorrect or inaccurate capture of entry information, including, but not limited to, technical malfunctions, human or technical error, printing errors, lost / delayed / garbled data or transmission, omission, interruption, deletion, defect or failures of any telephone or computer line or network, computer equipment, software or any combination thereof. Sponsor is not responsible for electronic network, scanner or computer hardware or software malfunction and/or transmission failure, loss or delayed or corrupted data transmissions, or any technical or human failures, errors or difficulties of any kind.
3. ELIGIBILITY: The Giveaway is open to any customer who is 18 years of age or older at time of the Giveaway. It is void outside of the Store and where prohibited or restricted by law.
4. PURCHASE EXCLUSIONS: A purchase is not required to obtain a mystery gift card. The mystery gift card may only be redeemed at stores operating under the same banner as the Store in which the gift card was received and may not be used to purchase any of the following items: alcohol, tobacco, gift cards, money orders, postage stamps, pharmacy prescriptions, fees, FTD, charitable donations, Western Union, utility payments, vending machines, bottle deposit/refunds, event tickets, and lottery. 5. REDEMPTION: To redeem a mystery gift card, present your card upon checkout. The value of the card will vary, anywhere from $1 to $500, with no maximum value guaranteed for any particular Event. The value of the mystery gift card can be revealed by the scanning the card at any register. The mystery gift card may not be redeemed for cash or other gift cards. The value of any purchase made with the mystery gift card that is returned will be refunded via another gift card or store credit.
6. VALUE: Each store will hand out a predetermined number of mystery gift cards, which will vary by Event. The value of the card is unknown at the time of distribution. Sponsor reserves the right to substitute the prize (or portion of the prize) with a prize of comparable or greater value if the prize cannot be awarded as described for any reason.
7. GENERAL RULES: Sponsor reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Giveaway or violates the Official Rules. Participants agree to be bound by these Official Rules. All aspects of the prizes are nontransferable and no substitutions are allowed except at the Sponsor’s sole discretion. Dates are subject to change. If an Event is cancelled for reasons out of Sponsor’s control, Sponsor reserves the right to cancel the Giveaway. No cash equivalent or exchange of prizes is permitted (except at the Sponsor’s sole discretion). By participating in this Giveaway, all entrants hereby agree and each entrant hereby remises, releases and forever discharges and agrees to indemnify and hold harmless Sponsor and its respective parents, subsidiaries, affiliates, directors, officers, employees and assigns, promotion agencies and agents from any and all liability, claims, actions, and damages sustained or incurred by participation in the Giveaway and the receipt and use of any prize(s) awarded (if any) arising in any manner whatsoever, including but not limited to an act or omission, whether negligent, intentional or otherwise caused by Sponsor. Neither the Sponsor nor the Sponsor Affiliates make any warranty, representation or guarantee, express or implied, in fact or in law, relative to the use of the mystery gift card. The recipients, in accepting the gift card, consent to the use of their names, addresses (city, state), photographs and likenesses for purposes of advertising, trade and promoting in any and all media on behalf of the Sponsor, without further compensation, except where prohibited by law. If, for any reason, the Giveaway is not capable of running as planned, including, but not limited to, tampering, unauthorized intervention, fraud or any other causes beyond the reasonable control of Sponsor and Sponsor Affiliates that corrupt or affect the administration, security, fairness, integrity or proper conduct of the promotion, then Sponsor and Sponsor Affiliates reserve the right at their sole discretion to cancel, terminate, modify or suspend the Giveaway. No more than the stated number of mystery gift cards will be provided.
8. GOVERNING LAW & VENUE: Except where prohibited, by participating in this Giveaway, participants agree that all issues and questions concerning the construction, validity, interpretation, administration, and enforceability of the Official Rules, or rights and obligations of the participants redeeming gift cards, shall be governed by and construed exclusively in accordance with the laws of the state of Florida without giving effect to any principles of conflicts of law of any jurisdiction and that: (1) any and all disputes, claims, and causes of actions arising out of, or connected with, this Giveaway, shall be resolved individually, without resort to any form of class action; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating, but in no event attorney’s fees; (3) under no circumstances will any participant be permitted to obtain awards for and hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. By redeeming, or attempting to redeem, gift cards, all participants agree to be subject to jurisdiction of the federal and state courts encompassing Jacksonville, Florida and agree that all disputes relating in any way to this Giveaway must be resolved in such courts.
